Agreement to these terms
These terms and conditions ("Terms") govern your access to and use of the Carepad website and platform. By using Carepad, you agree to these Terms. If you are using Carepad on behalf of an organisation, you confirm that you have authority to bind that organisation.
If you do not agree to these Terms, you must not use Carepad.
About Carepad
Carepad provides cloud-based care management software for care organisations. Features, availability, and plan limits are described on our website or in your order or subscription agreement.
Accounts and access
You are responsible for keeping login credentials confidential and for all activity under your account. Organisations must manage user access appropriately, including removing access when staff leave and assigning roles that reflect job responsibilities.
We may suspend or terminate access if we reasonably believe there has been a breach of these Terms, a security risk, or non-payment.
Acceptable use
You must not:
- use Carepad in any unlawful way or in breach of applicable care, health, or data protection regulations;
- attempt to gain unauthorised access to systems, accounts, or data;
- interfere with or disrupt the platform, including introducing malware or excessive automated requests;
- copy, reverse engineer, or resell the service except as expressly permitted.
Your data and responsibilities
You retain ownership of data you enter into Carepad. You are responsible for the accuracy, lawfulness, and appropriateness of that data, including information about people receiving care and your staff.
You must have a lawful basis to process personal data in Carepad and, where required, appropriate privacy notices and agreements in place with data subjects and staff.
Our role as a processor
Where Carepad processes personal data on your organisation's instructions, we act as a data processor (or service provider) and will process data only in accordance with your agreement with us and applicable data protection law.
Subscriptions, trials, and payment
Paid subscriptions, trials, billing cycles, and cancellation terms are set out at the point of purchase or in your commercial agreement. Unless otherwise stated, subscriptions renew automatically until cancelled in accordance with your plan terms.
Pricing shown on our website is indicative. Final pricing may be confirmed as part of a sales or onboarding process.
Availability and support
We aim to keep Carepad available and reliable, but we do not guarantee uninterrupted access. Planned maintenance, third-party outages, or events outside our reasonable control may affect availability. Support levels depend on your plan and agreement.
Intellectual property
Carepad, including its software, branding, documentation, and website content, is owned by us or our licensors. We grant you a limited, non-exclusive right to use the platform during your subscription, subject to these Terms.
Disclaimer and limitation of liability
Carepad is provided on an "as is" basis to the extent permitted by law. We do not provide medical, clinical, or legal advice. You remain responsible for care decisions and regulatory compliance.
Nothing in these Terms excludes liability that cannot be excluded under applicable law. Subject to that, our total liability arising from or related to the service is limited to the amount paid by you for Carepad in the twelve months before the event giving rise to the claim, except where a different limit is set out in your commercial agreement.
Termination
You may stop using Carepad in accordance with your subscription terms. On termination, access to the platform will end and data export or deletion will be handled as set out in your agreement and our privacy policy.
Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, unless mandatory law provides otherwise.
